A party not satisfied with the audiovisual programme classification decision made by an audiovisual programme classifier may submit a written rectification request, as specified in section 30 of the Act on Audiovisual Programmes, to the Finnish Arts and Culture Agency.

The rectification request may be submitted by the party to whom the classification decision is directed, or whose rights, obligations or benefits are directly affected by the decision. In most cases, the party to the matter is the party who ordered the classification.

Please note: A classification decision made by the Finnish Arts and Culture Agency can be appealed to the Audiovisual Programme Board. If the Finnish Arts and Culture Agency reclassifies a programme by decision, the audiovisual programme classifier who carried out the original classification may be considered a party to the matter.

Deadline for submitting the rectification request

The parties to the matter are notified of the classification decision by email and it is also published in the list of audiovisual programmes kept by the Finnish Arts and Culture Agency. The rectification request concerning a classification decision made by an audiovisual programme classifier must be submitted within 30 days of the date on which the party in question was notified of the classification decision.

Content of the rectification request

The rectification request must be submitted in writing. Under the Act on Electronic Services and Communication in the Public Sector (13/2003), a document submitted by email is also considered a written document. 

The rectification request must contain the following information:
– audiovisual programme classification decision that the rectification request concerns
– changes that should be made to the classification decision
– the grounds on which the classification decision should be changed
– the grounds on which the party submitting the rectification request is entitled to submit the request
– the party submitting the rectification request
– contact details of the party submitting the rectification request

Delivering the rectification request

The rectification request must arrive at the Finnish Arts and Culture Agency before 16.00 on the last day of the rectification request period.

A fee is charged for the decision made on the basis of the rectification request

The decision issued on the basis of the rectification request costs EUR 100. The Finnish Arts and Culture Agency notifies the party submitting the rectification request and the audiovisual programme classifier responsible for the original classification decision of the reclassification decision that it has made on the basis of the rectification request.

The authority to which the rectification request should be submitted 

The Finnish Arts and Culture Agency is the authority to which the rectification request should be submitted.

Appeal against the decision of the Finnish Arts and Culture Agency

The decision made by the Finnish Arts and Culture Agency on the basis of the rectification request concerning the classification decision made by an audiovisual programme classifier can be appealed against to the Audiovisual Programme Board. The appeal must be submitted within 14 days of the date on which the party in question was notified of the decision.
