Notification of the provision of audiovisual programmes and the supervision fee


In certain cases, the provider of audiovisual programmes and video-sharing platform services must notify the National Audiovisual Institute of the provision of audiovisual programmes (enter its details in the register of audiovisual programme providers maintained by the National Audiovisual Institute). The notification is intended as a tool for the authorities so that they can supervise the provision of audiovisual programmes. 

Submitting the notification does not exempt the provider in question from observing the other obligations laid down in the Act on Audiovisual Programmes. 

A party that provides audiovisual programmes for economic purposes and on a regular basis must enter its details in the register. Both criteria must be met.

  • The notification is not required if only one of the criteria is met.

The notification is not required if the provider only providers audiovisual programmes that under sections 9–11 of the Act on Audiovisual Programmes are exempted from the classification and labelling obligation.

  • The notification obligation also applies to the providers of audiovisual programmes that are unequivocally intended for persons aged over 18 (such as adult entertainment and certain types of unclassified films containing violence). The providers of such audiovisual programmes must provide the National Audiovisual Institute with a list of the titles of their audiovisual programmes on request.
  • At the request of the National Audiovisual Institute, the audiovisual programme provider must submit the Institute a list of the titles of these audiovisual programmes. 

The National Audiovisual Institute assesses on a case-by-case basis whether the prerequisites for notification are met.

Audiovisual programmes may be provided for economic purposes on the following basis: 

  • All provision that is mainly in the form of economic activity 
  • Providing audiovisual programmes as a company 
  • Mainly advertising-funded activities in which a single audiovisual programme can be viewed free of charge 
  • Activities not carried out by non-profit actors (local government or central government actors such as schools and public libraries)

The National Audiovisual Institute may order a provider of audiovisual programmes or video-sharing platform services to notify the Institute of the provision of audiovisual programmes (enter its details in the register of audiovisual programme providers maintained by the National Audiovisual Institute) and pay the supervision fee. A party not satisfied with the decision can request rectification from the National Audiovisual Institute. The decision on the rectification request can be appealed against to the Administrative Court.

Supervision fee 

A party that has registered as an audiovisual programme provider must pay a supervision fee each calendar year.

The supervision fee is charged to cover the costs arising from the supervision.

The supervision fee is determined on the basis of how the audiovisual programmes are provided or whether a video-sharing platform service is used. Provisions on the size of the supervision fee are laid down in the Act on Audiovisual Programmes and the National Audiovisual Institute does not decide on the size of the fee. 

The fee is collected for the first time for the calendar year during which the provision of audiovisual programmes starts. The supervision fee or part is not refunded if the provider ceases its activities during a calendar year. 

The supervision fee is directly enforceable without a court decision.

Size of the supervision fee

1) regional television programme output – EUR 100 

2) business premises where audiovisual programmes are publicly shown and other similar facilities – EUR 200 

3) business premises where recordings of audiovisual programmes are provided and other similar facilities – EUR 100 

4) on-demand service – EUR 400 

5) a set of programmes of an operator retransmitting foreign television broadcasts – EUR 400

6) nationwide television programme output – EUR 600

7) video-sharing platform service – EUR 400
